Acting as the Airport Land Use Commission (ALUC), SBCAG
has released
a set of questions and answers relating to the Airport Area of Influence
issue.
IMPACTS AND NOTIFICATION OF AIRPORT INFLUENCE AREAS (AIA):
Implementing the Requirements of AB 2776
Q. What is an airport influence
area (AIA)?
A. An airport influence area is the defined space surrounding an
airport that can be affected by airport operations.
Q. What is AB 2776 and when does it take effect?
A. AB 2776 was a bill passed in 2002 that takes effect January 1, 2004.
It requires that any person who is selling property to file a report
with the Department of Real Estate that said property is located within
an airport
influence area.
Q. How are Airport Influence Areas Determined?
A. Airport Influence Areas are based on airport flight patterns that
generate noise and safety issues associated with aircraft overflights.
The attached
map includes the AIA boundary for your airport.
Q. Which agency adopts the AIA boundary?
A. The Santa Barbara County Association of Governments, acting as the
Airport Land Use Commission for Santa Barbara County, adopted the AIA
boundary
in September, 2003.
Q. What types of property does this apply to?
A. AB 2776 applies to subdivided lands, common interest developments,
and residential properties, within California, which are offered for
sale or
lease.
Q. What type of noticing is required?
A. The law mandates the following notice: NOTICE OF AIRPORT IN VICINITY
This property is presently located in the vicinity of an airport, within
what is known as an airport influence area. For that reason, the property
may be subject
to some of the annoyances or inconveniences associated with proximity to
airport operations (for example: noise, vibration, or odors). Individual
sensitivities
to those annoyances can vary from person to person. You may wish to consider
what airport annoyances, if any, are associated with the property before
you complete your purchase and determine whether they are acceptable
to you.
